General Terms and Conditions of Messe Offenburg-Ortenau GmbH for the Purchase of Tickets via Internet

I. Scope of Application

The following terms and conditions apply to contracts for the sale of admission tickets (hereinafter referred to as Tickets) via the Internet between Messe Offenburg-Ortenau GmbH (hereinafter referred to as Messe Offenburg) and the purchaser of Tickets (hereinafter referred to as Customer). Counter-confirmations of the Customer with reference to his own terms and conditions of business or purchase are hereby contradicted. Deviations from the General Terms and Conditions of Messe Offenburg-Ortenau GmbH shall only be effective if they have been confirmed in writing by Messe Offenburg-Ortenau GmbH.

II. Conclusion of Contract

By sending his order, the customer submits a binding offer. The contract shall be concluded when Messe Offenburg-Ortenau GmbH initiates the booking or debiting of the amount. The customer waives receipt of the acceptance.

III. Contract Fulfillment by the Customer

The prices for tickets are shown on the respective website. The prices stated on the website at the time of the order are decisive. The purchase price is due for payment immediately after conclusion of the contract. The customer shall pay the amount indicated in his order by credit card, by PayPal or by direct debit, provided that payment by direct debit is possible on the respective website. Messe Offenburg-Ortenau GmbH accepts the credit cards listed on the website. Fulfillment occurs in both cases only when the amount is credited to the account of Messe Offenburg-Ortenau GmbH.

Messe Offenburg-Ortenau GmbH is entitled to require the customer to wear an FFP-2 mask in the entire event area in accordance with the official directives or legal regulations in force at the time of the event.

Messe Offenburg-Ortenau GmbH is entitled to register the visitors entering the event area in accordance with the official orders or legal regulations in force at the time of the event in order to enable contact tracing in the event of a subsequently identified COVID-19 case among visitors.

IV. Fulfillment of Contract by Messe Offenburg-Ortenau GmbH

The customer will receive an e-mail from Messe Offenburg-Ortenau GmbH containing the ticket for self-printing (Print@home ticket) as well as a mobile ticket (Passbook/Wallet App). Admission to the respective event is granted exclusively with this Print@home or Mobile Ticket. Purchased tickets will not be taken back.

Excluded from attending the event are

    Persons with contact to COVID-19 cases within the last 14 days.
    Persons with acute, non-specific general symptoms and respiratory symptoms of any severity
    persons under quarantine

Messe Offenburg-Ortenau GmbH is entitled to permit a customer to attend the event only if the customer presents appropriate proof of a negative result of a COVID-19 test, a complete vaccination against COVID-19 or the existence of a previous infection with the coronavirus SARS -CoV-2, in accordance with the official directives or legal regulations in force at the time of the event.

Customers who are excluded from attending the event for the present reasons remain obliged to pay the ticket fee and are therefore not entitled to a refund of the ticket fee paid. Further claims are excluded.

In order to ensure compliance with the protective and hygienic measures prescribed by law, Messe Offenburg-Ortenau GmbH is entitled to limit the number of persons in the entire event area or in parts thereof. Messe Offenburg-Ortenau GmbH may therefore temporarily deny customers access to the entire event area or parts thereof. If a customer who enters the exhibition grounds on an event day in order to attend the event is not permitted to visit at least part of an event area on that day due to the aforementioned restrictions, the customer may demand reimbursement of the pro rata ticket fee in the case of a multi-day ticket and reimbursement of the entire ticket fee in the case of a one-day ticket, in which case the customer shall lose his right to use his one-day ticket to attend the event on another day. Further claims are excluded.

V. Cancellation policy for consumers

1. right of revocation

If the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), he may revoke his declaration of intent to conclude the contract within 14 days without stating any reasons by using the revocation form or by making an express declaration (e.g. letter, e-mail, fax) to Messe Offenburg-Ortenau GmbH. To meet the deadline, it is sufficient to send the cancellation form or to submit the cancellation declaration to Messe Offenburg-Ortenau GmbH in good time. The revocation period shall commence upon conclusion of the contract, but not before Messe Offenburg-Ortenau GmbH has informed the consumer in accordance with the statutory requirements (Section 312 j (2) of the German Civil Code (BGB) in conjunction with Article 246a Section 1 (1) sentence 1 nos. 1, 4, 5, 11 and 12 of the Introductory Act to the German Civil Code (EGBGB)).

The revocation is only possible within the revocation period up to the point in time at which the ticket or voucher number loses its validity, i.e. at the end of the opening hours on the last day of the trade fair.

2. consequences of the revocation

If the right of revocation is effectively exercised, the tickets in question will be blocked so that access to the event in question is not possible.

In the event of an effective revocation, Messe Offenburg-Ortenau GmbH will refund the ticket price already paid by the consumer without delay, but no later than after 14 days.

For the consumer, the period begins with the sending of the cancellation form or with the other submission of the cancellation declaration, for Messe Offenburg-Ortenau GmbH with the receipt.

Messe Offenburg-Ortenau GmbH is free to choose the means of repayment for the ticket price already paid. No fee will be charged to the consumer.

VI Liability

Messe Offenburg-Ortenau GmbH shall be liable for intent and gross negligence. In the event of slight negligence, Messe Offenburg-Ortenau GmbH shall only be liable for the violation of essential contractual obligations, in particular the main contractual obligations. In the event of slight negligence, Messe Offenburg-Ortenau GmbH shall be liable for typically foreseeable damages, but not for consequential damages and at most to 10 times the amount of the order value. Excluded from the above limitations of liability is the liability of Messe Offenburg-Ortenau GmbH for damages resulting from injury to life, body or health, which are based on a negligent breach of duty by the User or an intentional or negligent breach of duty by a legal representative or vicarious agent of the User.

VII Force Majeure, Cancellation of the Event

If, as a result of force majeure or for other reasons for which Messe Offenburg-Ortenau GmbH is not responsible, Messe Offenburg-Ortenau GmbH is compelled to clear one or more exhibition areas temporarily or even for a longer period of time, or to postpone or shorten the event, this shall not entitle the customer to withdraw from the contract, to terminate the contract or to reduce the price, or to assert any claims, in particular claims for damages against Messe Offenburg-Ortenau GmbH. The same shall apply if the customer is unable to participate in the trade fair as a result of force majeure or for other reasons for which Messe Offenburg-Ortenau GmbH is not responsible.

VIII Right of withdrawal due to travel restrictions

The customer shall have a right of withdrawal if a statutory or official regulation exists according to which, at any time within a period of six weeks prior to the first day of the event, no one may leave or enter Germany from the country or part of the country in which the customer is domiciled, or anyone entering Germany from the country or part of the country in which the customer is domiciled must go into quarantine immediately after entry.

The customer also has the right to withdraw from the event if there is a statutory or official regulation in force for an indefinite period of time or at least until the day after the last day of the event that no one who has been in Germany or in the part of Germany in which the event took place at any time during the term of the event is allowed to leave Germany or enter the country or into the part of the country in which the customer resides, or anyone who has stayed in Germany or in the part of the country in which the event has taken place at any time during the term of the event, enters the country or the part of the country in which the customer resides, must go into quarantine immediately after entry.

 

IX. Place of performance and jurisdiction

The place of jurisdiction for all legal disputes arising from the contract shall be Offenburg, if the contracting parties are merchants, legal entities under public law or special funds under public law, or if at least one of the contracting parties has no general place of jurisdiction in the Federal Republic of Germany, or if, after conclusion of the contract, it moves its place of residence or habitual abode outside the Federal Republic of Germany, or if its place of residence or personal abode is not known at the time the action is brought. Messe Offenburg-Ortenau GmbH shall also be entitled to bring an action at the customer's general place of jurisdiction. The place of performance for all obligations arising from this contract is Offenburg.

X. Applicable Law

The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

XI Final clause

Should one or more provisions of this contract be or become invalid in whole or in part, the remainder of the contract shall remain valid. Invalid provisions shall be replaced by provisions which come closest to the purpose intended by the parties.
